These Terms of Service (“Terms”) are an agreement between you and NakedRabbitProduction LLC (“we”, “us”) and apply to Pirate Vortex, Fluffy Office, Classroom Escape, Pug Pool, Ninja Bamboo, and any other games or apps we publish, and this website (the “Services”). By downloading, installing or playing, you agree to these Terms and our Privacy Policy. If you don’t agree, please don’t use the Services.

1. Who can play

You must be old enough to agree to these Terms in your country, or have a parent or guardian agree for you. Parents are responsible for purchases and play by their children.

2. Your license

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and play our games for your own non-commercial entertainment, on devices you own or control, under these Terms and the rules of the store you got the game from. You may not copy, modify, reverse-engineer, decompile, resell, rent or distribute the games, use cheats, bots, hacks or unauthorized third-party software, exploit bugs, or interfere with other players or our servers.

You are welcome to stream and post videos of our games, including monetized videos, as long as you don’t suggest we endorse you.

3. Virtual items and purchases

Games may include virtual currency and items (“Virtual Items”) that can be earned or bought. Virtual Items have no real-world value, cannot be exchanged for cash, and are licensed to you, not sold. Purchases are processed by Apple, Google or Valve, and their refund policies apply. Except where the law requires otherwise, all purchases are final. We may change or remove Virtual Items as games evolve, and Virtual Items may be lost if a game is discontinued or your data is deleted.

4. Ads

Free games may show advertisements. Some games offer an optional purchase to remove ads; rewarded ads you choose to watch may still be available.

5. Player content and conduct

If a game lets you choose a name or communicate with others, you must not post anything illegal, hateful, harassing, sexual, or that infringes someone else’s rights. We may remove content and suspend or terminate access for violations. You give us a license to host and display content you submit within the Services.

6. Ownership

The games, characters, artwork, music, code and trademarks are owned by NakedRabbitProduction LLC or our licensors and are protected by law. All rights not expressly granted are reserved.

7. Updates and availability

We may update, change or discontinue any game or feature at any time. Some features require an internet connection. We don’t guarantee the Services will always be available or error-free.

8. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, TO THE FULLEST EXTENT PERMITTED BY LAW.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, NAKEDRABBITPRODUCTION LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, AND OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR US $50. Some jurisdictions don’t allow these limits, so they may not apply to you; nothing here limits rights you have under consumer law that cannot be waived.

10. Governing law

These Terms are governed by the laws of the State of New York, USA, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in New York, unless your local consumer law gives you the right to bring claims where you live.

11. Apple-specific terms

If you downloaded a game from the Apple App Store: these Terms are between you and us, not Apple; Apple has no obligation to provide maintenance or support; if the game fails to conform to any warranty you may notify Apple for a refund of the purchase price (if any), and Apple has no other warranty obligation; Apple is not responsible for addressing claims relating to the game, including product liability, legal or regulatory claims, or intellectual-property claims; you represent you are not located in a country subject to a US embargo or on a US prohibited-parties list; and Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Apple’s Standard Licensed Application End User License Agreement also applies where these Terms are silent.
