Overview

Welcome to FeatherSouls Films. The terms “we,” “us,” and “our” refer to FeatherSouls Films, a wedding cinematography studio. These Terms of Service (“Terms”) govern your use of our website, client portal, and the wedding film services we provide (collectively, the “Services”).

The specific terms of your wedding coverage — including coverage hours, deliverables, retainers, rescheduling fees, and licensing — are set out in the signed Wedding Cinematography Agreement between you and FeatherSouls Films (the “Agreement”). If anything in these Terms conflicts with your signed Agreement, the Agreement controls for your booking.

By visiting this website, submitting an inquiry, or booking a wedding film with us, you agree to these Terms and our Privacy Policy.

Section 1 — Inquiries & Bookings

When you submit an inquiry or booking request, you are asking FeatherSouls Films to consider filming your wedding. We reserve the right to accept or decline any inquiry in our sole discretion.

Your wedding date is not reserved until both of the following have been received: (a) your signed Agreement, and (b) your retainer payment. Until both are received, your date remains available to other couples.

Section 2 — Retainer & Payment

A non-refundable retainer equal to 50% of your total investment is required to reserve your wedding date. This retainer covers the date block, pre-production planning, and preparation for your wedding.

The remaining balance is due no later than 14 days before your wedding date unless otherwise stated in your Agreement. Payments are processed through Stripe via our client portal.

Add-ons and optional services may be added up until the payment cutoff defined in your Agreement; after that point, add-ons are handled as amendment requests through the portal and may be accepted at our discretion.

Section 3 — Rescheduling

If you need to move your wedding date, we will do our best to accommodate a new date subject to our availability. Rescheduling is subject to a $3,500 rescheduling fee plus any travel or vendor costs already incurred. Your retainer applies to the new date. If we are not available on the new date, the booking is treated as a cancellation under Section 4.

Section 4 — Cancellation

You may cancel your booking in writing. The 50% retainer is non-refundable in all cases, as it compensates us for holding your date and turning away other inquiries.

If you cancel within 14 days of your wedding date, the full contracted balance is due, as we have committed crew, equipment, and travel resources to your date and no longer have meaningful opportunity to rebook.

Section 5 — Coverage & Event Day

We will arrive at the time and location set in your Agreement and film the events listed on your agreed shooting schedule. Our coverage includes only the hours in your package. Additional coverage on the day of the event is billed at $300 per half hour and must be approved by FeatherSouls Films before it is added.

We rely on the timeline you and your planner provide. Delays caused by other vendors, the couple, the venue, weather, or factors outside our control do not extend coverage unless overtime is approved.

You are responsible for obtaining any permissions we need to film at your venue(s), including permits, officiant consent, and venue rules. We will always respect venue or officiant restrictions on camera placement, audio, or lighting.

Section 6 — Delivery & Turnaround

Estimated delivery timelines for your highlight film, full-length film, and any other deliverables are stated in your Agreement. These timelines are estimates, not guarantees. Delivery times do not start running until all required items from you (music approvals, addresses, vow audio requests, etc.) are received.

Final films are delivered digitally through our client portal. Once delivered, you are responsible for downloading and backing up your files during the download window; we are not liable for loss of files that were not downloaded in time.

Section 7 — Revisions

Revision rounds, if any, are described in your Agreement. Revisions cover small changes such as music choice, clip trims, and text edits. Revisions do not include re-edits of creative direction, color, pacing, or story structure, which reflect our artistic judgment.

Section 8 — Creative License

You are hiring FeatherSouls Films for our specific cinematic style. We retain full creative control over editing choices, color, music, pacing, structure, and storytelling. If you have reviewed our portfolio and booked us, you are agreeing to our creative vision.

Section 9 — Copyright & Licensing of Your Film

FeatherSouls Films retains the copyright to all footage and films we create. You receive a personal, non-exclusive, non-commercial license to view, download, share, and display your wedding films for personal purposes (social media, family, personal websites). Any commercial use of the films — including licensing to vendors, venues, or sponsors — requires our prior written consent.

By default, we may feature excerpts and stills from your wedding on our portfolio, website, social media, festival submissions, educational content, and marketing. If you prefer that we not use your wedding for any of these purposes, you may add our Privacy Rights Buyout (25% of your total investment), which removes your wedding from all public and marketing use.

Section 10 — Raw Footage

Raw (unedited) footage is not included in any package. We do not typically release raw footage, as it does not represent our finished work. Any request for raw files is subject to a separate written agreement and fee.

Section 11 — Travel, Accommodation & Venue Fees

Travel beyond our standard service area, including mileage, flights, lodging, and meals, is billed as described in your Agreement or as quoted in writing. You are responsible for any permits, venue fees, or third-party charges required to film at your chosen location(s).

Section 12 — Equipment & Unforeseen Circumstances

We use professional, well-maintained equipment and carry redundant gear. In the rare event of a camera, audio, or media failure that affects part of your coverage, our liability is limited as set out in Section 16.

If a member of our crew is prevented from attending your wedding due to illness, injury, or other emergency, we will make reasonable efforts to arrange a qualified replacement shooter. If no replacement can be arranged and the event cannot be filmed, our liability is limited to a refund of the amounts paid for the un-filmed portion.

We are not liable for events beyond our reasonable control, including acts of God, severe weather, natural disasters, fire, pandemic, war, civil unrest, power outages, venue closures, government orders, or failures of third-party vendors or internet/hosting services (“Force Majeure”). In a Force Majeure event, we will work with you in good faith to reschedule or adjust services where possible.

Section 13 — Your Responsibilities

You agree to: (a) provide accurate event information, timelines, and vendor contacts; (b) make reasonable introductions to your planner, venue, and officiant so we can coordinate coverage; (c) respond in a timely manner to portal requests (music approvals, invoice, questionnaire, revision feedback); and (d) treat our team with professional courtesy on the day of your wedding.

Section 14 — Third-Party Vendors

We often film alongside photographers, planners, DJs, and other vendors. We are not responsible for the actions, professionalism, timing, or deliverables of vendors we do not control. If another vendor's behavior materially prevents us from capturing key moments, we will document the issue and continue to deliver the best film possible from the footage we were able to capture.

Section 15 — Website & Client Portal Use

Our website and client portal are provided for you to review your booking, sign your Agreement, make payments, submit questionnaires, approve selections, and receive delivered films. You agree not to: (a) share your portal access with anyone other than your partner or planner (with your consent); (b) attempt to access other clients' files; or (c) scrape, copy, or redistribute portfolio content. All brand elements, films, photos, and written content on our website are owned by FeatherSouls Films.

Section 16 — Limitation of Liability

To the fullest extent permitted by law, our total liability arising out of or relating to your booking, regardless of the legal theory, is limited to the total amount you have paid to FeatherSouls Films for the services in question. We are not liable for indirect, incidental, consequential, or punitive damages, including lost memories, emotional distress, or lost profits.

Section 17 — Disclaimer

Films and stills displayed on our website and social media represent sample work and are not a guarantee that your wedding will look identical. Every wedding is unique in lighting, venue, and circumstance.

Section 18 — Indemnification

You agree to indemnify and hold harmless FeatherSouls Films, its owners, employees, and contractors from any claims arising from: (a) your breach of these Terms or your Agreement; (b) your use of the delivered films outside the license granted; or (c) claims by third parties (including guests or other vendors) related to your wedding that are not caused by our gross negligence or willful misconduct.

Section 19 — Governing Law

These Terms and your Agreement are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. Any dispute will be resolved exclusively in the state or federal courts located in New York.

Section 20 — Entire Agreement & Severability

These Terms, together with your signed Agreement and our Privacy Policy, form the entire agreement between you and FeatherSouls Films regarding your booking. If any provision is held unenforceable, the remaining provisions will remain in full effect.

Section 21 — Assignment

You may not assign or transfer your booking to another couple or party without our prior written consent. We may assign this Agreement to a successor entity (for example, in the event we restructure the business).

Section 22 — Changes to These Terms

We may update these Terms from time to time. The current version will always be available in the client portal and on our website. Material changes will not apply retroactively to bookings already under a signed Agreement.

FeatherSouls Films is a wedding cinematography studio. This Privacy Policy explains what information we collect from you as a couple or prospective client, how we use it to plan, film, edit, and deliver your wedding film, and how we use footage and stills from your wedding in our portfolio (and how you can opt out).

By inquiring, booking with us, or using our client portal, you agree to this Privacy Policy.

Information We Collect

• Contact & event details — your name(s), partner's name, email, phone, mailing address, wedding date, venue(s), ceremony and reception locations, and the shooting schedule you share with us.
• Booking information — package selection, add-ons, travel requirements, and amendments made through the portal.
• Payment information — billing details required to process retainer and balance payments. Card details are handled directly by our payment processor (Stripe); we do not store full card numbers on our servers.
• Questionnaire & planning responses — details you provide about your story, family, music preferences, vow audio, and anything else you share to help us film and edit your wedding.
• Media — the video and audio we record at your wedding, including footage of you, your partner, wedding party, family, and guests.
• Portal & website usage — basic technical information such as IP address, browser type, device type, and pages viewed, collected through standard logs and cookies.
• Communications — emails, portal messages, and notes from consultations.

How We Use Your Information

• Run your booking — to send and execute your Agreement, collect retainers and balances, schedule coverage, coordinate with your planner and venue, and deliver your final films.
• Plan and edit your wedding film — to build your shooting timeline, produce your highlight and full-length films, and respond to your revision feedback.
• Communicate with you — to send booking updates, payment reminders, delivery notices, and respond to your questions.
• Portfolio & marketing — by default, we may use excerpts, stills, and full films from your wedding on our website, portfolio, social media, festival submissions, wedding publications, and educational content. You can opt out by adding the Privacy Rights Buyout described in your Agreement (25% of your total investment).
• Legal & security — to prevent fraud, enforce our Terms, resolve disputes, and comply with applicable law.

How We Share Information

We do not sell your personal information. We share it only with the following:

• Our crew and contracted shooters/editors who need it to film or edit your wedding.
• Payment processor (Stripe) to handle retainer and balance payments.
• Hosting and delivery platforms used to store footage, host your client portal, and deliver your finished films.
• Your wedding vendors (planner, venue, photographer) only to the extent needed to coordinate coverage.
• Legal authorities if required by law, subpoena, or valid legal process, or to protect our rights or the safety of others.
• A successor entity if FeatherSouls Films is ever sold, merged, or reorganized.

Use of Wedding Footage & Likeness

Because wedding films are inherently promotional work for a cinematography studio, by default we retain the right to feature your wedding in our portfolio and marketing as described in your Agreement and Section 9 of our Terms. If you do not want your wedding used publicly, please add the Privacy Rights Buyout before delivery. Guests are not required to sign individual releases, and we ask couples to let guests know that a videographer will be present.

Minors

Children who attend your wedding may appear in the footage we capture. If you would prefer that footage featuring specific minors not be used in marketing, let us know and we will honor that request in our public-facing edits (the full-length film you receive is unaffected). We do not knowingly collect personal information from children online through our website.

Cookies & Analytics

Our website and client portal use standard cookies and similar technologies to keep you logged in, remember your preferences, and understand basic traffic (for example, how many couples viewed our portfolio). You can disable cookies in your browser, but some parts of the client portal may not work correctly without them.

Data Retention

We keep your booking records, Agreement, and communications for as long as needed to provide the Services and for a reasonable period afterward for tax, legal, and business records. Original media (raw footage) is generally retained for a limited period after delivery; after that point, only the final deliverables and archival stills used in our portfolio may remain in our storage.

Security

We use reasonable technical and organizational safeguards to protect your information, including encrypted connections to the portal and access controls. No system is perfectly secure; please use a strong password and let us know promptly if you believe your portal access has been compromised.

Your Rights

Depending on where you live, you may have the right to:

• Request a copy of the personal information we hold about you;
• Request correction of inaccurate information;
• Request deletion of your information, subject to our legal and contractual retention needs (for example, we cannot delete records required for tax purposes or for a booking still in progress);
• Opt out of marketing emails by using the unsubscribe link in any promotional email;
• Opt out of the use of your wedding in our public portfolio and marketing by purchasing the Privacy Rights Buyout.

International Clients

FeatherSouls Films is based in the United States. If you are inquiring or booking from outside the U.S., your information will be transferred to and processed in the U.S. By using our Services, you consent to this transfer.

Changes to This Policy

We may update this Privacy Policy from time to time. The current version will always be available in the client portal and on our website, with an updated “Last updated” date.
